1. Provision Of Services And Client Accounts

A. Account Responsibility

To access our hosting platform or website management services, you may be required to create an account. You are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account.

B. Accurate Information

You agree to provide accurate, complete, and current business and contact information during registration and to promptly update your account information whenever changes occur.

2. Acceptable Use Policy (AUP)

Our hosting infrastructure and related services must be used only for lawful purposes. You agree not to:

• Store, distribute, or link to malware, viruses, Trojan horses, or other malicious software.
• Engage in unauthorized network attacks including phishing, brute-force attacks, port scanning, or denial-of-service activities.
• Send unsolicited bulk email (SPAM) or operate email services that violate industry standards.
• Host or distribute copyrighted content without proper authorization.

Houston Web Hosting reserves the right to suspend or terminate any service that violates this Acceptable Use Policy or negatively impacts the stability or security of our infrastructure.

3. Financial Terms, Billing & Subscriptions

A. Payment Cycles

Hosting plans, maintenance services, and recurring marketing services are billed in advance based on the agreed billing cycle (monthly, quarterly, or annually).

B. Late Payments & Suspension

Accounts with unpaid invoices may be suspended after the applicable grace period. Houston Web Hosting is not responsible for business interruption, data loss, reduced visibility, or revenue loss resulting from account suspension due to non-payment.

C. Cancellation

Subscription services may be cancelled by submitting a cancellation request through the client portal at least five (5) business days before the next billing date to prevent automatic renewal.

4. Third-Party Services

Our services may rely on third-party providers including domain registrars, payment gateways, cloud providers, email platforms, analytics services, and software vendors.

Houston Web Hosting is not responsible for outages, pricing changes, policy updates, or service interruptions caused by these third-party providers.

5. Disclaimer Of Warranties

Unless expressly stated in a written agreement, all services are provided on an "as available" and "as is" basis.

To the maximum extent permitted by law, Houston Web Hosting disclaims all warranties, including merchantability, fitness for a particular purpose, and non-infringement.

We do not guarantee uninterrupted hosting, specific search engine rankings, website traffic, sales performance, or other business outcomes.

6. Limitation Of Liability

To the fullest extent permitted by law, Houston Web Hosting shall not be liable for indirect, incidental, consequential, special, or punitive damages, including loss of profits, revenue, business interruption, or data.

Our maximum liability shall not exceed the amount paid for the specific service giving rise to the claim unless otherwise required by applicable law.

7. Indemnification

You agree to indemnify and hold Houston Web Hosting harmless against claims, damages, liabilities, costs, and expenses arising from your use of our services, website content, violations of these Terms, or infringement of third-party rights.

8. Termination

Houston Web Hosting reserves the right to suspend or terminate services if these Terms are violated, invoices remain unpaid, unlawful activity is detected, or continued service could compromise our infrastructure or customers.

Termination does not remove your obligation to pay any outstanding balances owed before termination.

9. Changes To These Terms

We may update these Terms periodically to reflect legal requirements, operational changes, or service improvements. Updated Terms become effective immediately upon publication on this page.

Continued use of our services after changes are published constitutes acceptance of the revised Terms.
